Format:

Lecture followed by question and answer period. Handouts provided describing the topics & issues for the particular program, e.g. Qualified Domestic Relations Orders (QDRO's) and Pension Valuation Techniques, Business Valuation issues, Investments, etc.  Relevant case law cited. 

Topics:

Effective use of QDRO's to divide retirement plans for property division, child support & child support arrearages, and alimony. Methods of dividing defined benefit plans and defined contribution plans with emphasis on defined benefit plans, both governmental and non-governmental retirement plans, and avoiding malpractice when drafting QDRO's. Valuation of pensions, determining the marital portion (3 approaches) and evaluating an opposing counsel's valuation.

QDRO's, often limited to traditional private pension plans, are only part of the topics covered.  Other types of pension plans to be covered include:

  • City, County & State Retirement System Plans
  • 457 Plans
  • Military
  • Railroad Retirement Plan
  • Civil Service (CSRS) & Federal Employees Retirement (FERS)
  • QDRO's for Child Support Arrearages

Valuing Businesses in Divorce emphasizes financial Issues in Divorce, Family Businesses included in Marital Estate, Separating Active and Passive growth in Business Value, Marketability and Minority Control issues, Evaluating Business Valuations Presented by Opposing Counsel, Special Circumstances: Value of Licenses, Permits, Professional Practices.  Several examples given and handouts provided.

Speakers:

Tim Voit, is a Financial Analyst and President of Voit Econometrics with a concentration in Pension, 401(k)'s, and Securities litigation. Tim is also a Court admitted expert on the drafting of Qualified Domestic Relations Orders (QDRO's), often called upon in legal malpractice cases to "fix" QDRO's and/or to compute/minimize damages for the carrier. Tim has had numerous articles published on the topics of valuing pensions and QDRO's in several different states and has lectured for CLE credits in those states as well, including Florida, Wisconsin & North Carolina.

Todd Voit
CFP, is an Economist/Portfolio Manager and President of Voit Investment Management, LLC. Todd Voit achieved a Top 20 Ranking in 1994 according to the Nelson's database of money managers and also teaches Economics and Investments at the undergraduate/graduate level for the University of Wisconsin (Ph.D. candidate). Some of Todd's other responsibilities include securities analysis for litigation and he serves from time to time as a NASD Arbitrator. Todd has one of the only Masters' Thesis we know of in the country on the topic of Valuing Pensions and Drafting QDRO's.

Ashok B. Abbott, PhD., is a professor of Finance with substantial business valuation & research experience and has also been admitted as an expert on valuing businesses in divorce.  Dr. Abbott has had numerous articles and research papers published on valuing businesses, writes regularly for a local newspaper, as well as advising on the value of Intellectual Property.
